ABSMC: HIPAA Reminders when Accessing Patient Records

To ABSMC Practitioners:

This is a reminder regarding access to patient records, including your own or those of family members. In general, access should be limited to the minimum necessary to facilitate Treatment, Payment or Healthcare Operations.

ACCESSING YOUR OWN EHR RECORD:
• May access your own medical records:
– Viewing purposes only
• Discuss your records with your healthcare provider if you need to:
– Ask questions
– Modify them

ACCESSING FAMILY MEMBER’S EHR RECORD:
• May access your family members’ medical records if:
– Providing treatment, OR
– Received prior written authorization (adult patients only)
• You are not permitted to access a minors record (including minor child) unless it relates to a treatment purpose

POTENTIAL CONSEQUENCES FOR INAPPROPRIATELY ACCESSING AN EHR RECORD:
• Medical staff privileges suspended, restricted or revoked
• The incident requires regulatory reporting
• Practitioners may be subject to further investigation, fines, and/or disciplinary action against their license
• Named in a lawsuit by the patient
• Physician termination from medical group
